SSP Changes: what if someone is sick when new rules take effect?

The government has recently announced revisions to Statutory Sick Pay (SSP) regulations, which will come into effect on 6th April 2026 as part of the Employment Rights Act 2025.

From this date, SSP will be payable from the first day of absence, eliminating the previous waiting period until day four. Additionally, the earnings threshold has been removed, meaning all eligible employees, regardless of earnings level, will qualify for SSP.

The weekly SSP will be the lesser of the standard rate (£123.25 for 2026/27) or 80% of the employee’s usual weekly earnings.

But, what happens if someone's sick leave begins shortly before 6th April? Any waiting days before 6th April will be under the old rules, and any from 6th April onwards are under the new rules.

There is also specific guidance on how to treat employees who wouldn't have been eligible for SSP under the old rules but are under the new rules, including linked periods of absence. The government has produced guidance for just this eventuality, which you can read here.
